Mediation is another form of dispute resolution. Mediation involves you and your spouse/former partner discussing the issues surrounding your divorce/separation with an independent mediator. The mediator must remain impartial throughout the process and cannot offer any legal advice. The mediator will attempt to help narrow the issues and assist in achieving an amicable agreement through the process.
If an agreement is reached during mediation the mediator will prepare a Memorandum of Understanding setting out what has been agreed. It is important to note that this is not a legally binding document.
Even if you mediate it is wise for both parties to obtain independent legal advice regarding the terms of settlement discussed during mediation. Furthermore, in order for an agreement to become legally binding a Consent Order will need to be drawn up by a firm of solicitors.
